Bicycles are an eco-friendly way to travel, it saves on fuel costs and keeps you fit, plus you don’t have to worry about finding a parking space! However this means sadly the numbers of bicycle accidents are rising.

The trial judge felt that due to the character of the road the pothole was not dangerous. Phil is appealing the judgement on the basis that the judge misapplied the test of dangerousness. Phil argues a pothole in the highway is either dangerous or not. The fact that it was on a country road should make no difference to the issue of whether the defect was dangerous.
